On August 29, 2008, in the Bullitt County, Kentucky, Train Derailment Litigation, in the United States District Court for the Western District of Kentucky at Louisville, the Honorable Thomas Russell entered the Order on this Home Page preliminarily approving a Settlement of a Class Action brought on behalf of persons or legal entities residing, owning real property or full-time employed between January 16 and 19, 2007 in the Class Area contained in Bullitt County, Kentucky and shown on the map attached to the Individual Notice on this Home Page against CSX Transportation, Inc. ("CSXT"), General Electric Capital Services, Inc., and General Electric Railcar Services, Inc. (Collectively "GE"), and respecting a train derailment.

The details of the Settlement are contained in the Settlement Agreement on this Home Page.

Possible Settlement payments for Class Members were described in the Individual Notice on this Home Page and had to be claimed by mailing a completed Claim Form to the Settlement Administrator by November 28, 2008.

Current Status of Settlement

On January 6, 2009, in the United States District Court for the Western District of Kentucky at Louisville, the Honorable Thomas B. Russell entered the Final Order on this Home Page giving final approval to the Settlement. The Settlement was funded on or about March 6, 2009. The Settlement Administrator began paying claims in April of 2009, with all valid claims being paid by December 15, 2009.

Under the terms of the Settlement Agreement, on this Home Page, if there are funds remaining in the Settlement Fund, and they exceed the amount set aside for a Cy-Pres award, the Settlement Administrator may petition the Court to approve a dividend payment to the Ordinary Monetary Benefit claimants under the Settlement.

As such excess funds are available, the Settlement Administrator on December 18, 2009 petitioned the Court for authority to make additional Ordinary Monetary Benefit claimant payments, and the Court authorized a dividend payment on January 21, 2010 as follows:
