On August 29, 2008 in the Bullitt County, Kentucky, Train Derailment Litigation, in the United States District Court for the Western District of Kentucky at Louisville, the Honorable Thomas B. Russell entered the Order on this Home Page preliminarily approving a Settlement of a Class Action brought on behalf of persons or legal entities residing, owning real property or full-time employed between January 16 and 19, 2007 in the Class Area contained in Bullitt County, Kentucky and shown on the map attached to the Individual Notice on this Home Page against CSX Transportation, Inc. ("CSXT"), General Electric Capital Services, Inc. and General Electric Railcar Services, Inc. (collectively, "GE"), and respecting a train derailment.

The details of the Settlement are contained in the Settlement Agreement on this Home Page.

Possible Settlement payments for Class Members are described in the Individual Notice on this Home Page and must be claimed by mailing a completed Claim Form to the Settlement Administrator by November 28, 2008.
